Client & Artiste Terms of Engagement
1. Booking
Your booking is only guaranteed when you send back (reply) to the original 'confirmation' email. I require you to check through the details and add or alter the contents to ensure it's accuracy. We both then have the same details and the engagement is accepted without reservation.
Any confirmation email not sent back within 72 hours of my sending the original confirmation email may be regarded as a change of heart by you, the client.
I will always take reasonable steps to contact you by telephone and email before removing your instruction from the diary. Where no contact is possible or where no return email or telephone call is received to advise me within this time frame, I reserve the right to book an alternative engagement in it's place.
I urge you to notify me upon booking as to holidays you may have planned which may prevent you from confirming within the agreed time.
I also urge you to write down my office telephone number 01992 46 96 93 so that you can contact me at anytime should your email or PC fail.
2. Payment
i. Payment of the contract is due on the day of the event. I do not require a deposit and I cannot offer credit terms without prior negotiation and agreement being reached and stated in the confirmation email.
ii. If you are having the event at your home address, payment can be in the form of Cash or Cheque. If you are having the event at an alternative venue, the payment is cash only. This is to eliminate the risk of being given fictitious home addresses and the cheque not being valid. Please understand this is not a reflection on you personally, but these terms apply to each and every client.
iii. Cheque's are only accepted outside home addresses where I am appearing at and on behalf of a School, Scout or Guide Group, Religious Organisation, Business or any other such body where the address relates directly to the organisers of the event as their 'head quarters', business premises or educational premises.
Please note that I am registered for Value Added Tax (VAT) and the price quoted is inclusive of VAT (at the current rate) unless the confirmation states otherwise.
3. Cancelling
You are required to give reasonable notice should you wish to cancel the booking. Reasonable notice under current Equity guidelines is around 30 days. I reserve the right to charge up to 100% of the value of the engagement should the engagement be cancelled within 30 days of the event date. This 'charge' will not be enforced where I am able to 'fill' the window with an alternative engagement, and in certain exceptional circumstances I may at my absolute discretion elect to waive the charge if I feel it is appropriate to do so.
Any booking made within 30 days of the engagement maybe cancelled without any redress being incurred within the first 72 hours following your confirmation of the engagement, otherwise the same conditions apply.
No cancellation shall be effective unless I have received confirmation in writing. Should you wish to cancel a booking you should notify me by email. I undertake to confirm receipt of any such notice by return. It is your responsibility to satisfy yourself that I have received any such notification. If you do not receive my confirmation, you should email me again, and telephone me to ensure that the cancellation is confirmed.
4. Withdrawal of Animals
I reserve the right to withdraw any or all of the animals that are due to appear at the engagement when.
i. Illness or death of an animal prevents me from showing the animal at your event.
ii. In circumstances where I feel the animals health or safety might be compromised.
Iii In circumstances where I feel an audience or individual members of the audience's health and safety might be compromised.
5. Parking
You, the Client are expected to provide parking for one standard sized motor vehicle as close to the venue as is realistic. Where parking restrictions are in force, you, the Client, are obliged to advise of parking bays and the maximum time allowed for parking within these bays. Where the length of the performance time exceeds the maximum length of time allowed to park, the performance may be cut short. This performance time also includes a 15 minute set up time before the commencement of the event and a 15 minute clearing at the conclusion of the event.
Where cost is incurred to park, particularly where such costs are higher than was envisaged when your booking was made, this may be added to the overall cost of the event.
Where fines are incurred through exceeding parking restrictions through reasons beyond my control, this will be added to the cost of the event also.
6. Hand Washing
You, the Client, are expected to provide adequate facilities for hand washing. This may include wet wipes or a bucket of warm soapy water or sink. It is your responsibility to ensure every member of the audience washes their hands at the interval and/or the conclusion of my presentation.
7. Acceptance of the Terms and Conditions
You, the Client, agree to all the above terms and conditions in full when you confirm the booking (see section 1 for confirming the booking). Any objections to any of these terms and conditions must be made prior to confirming the booking. Where a compromise cannot be reached to any objection, I reserve the right to cancel the engagement without any redress being incurred.
